PREAMBLE This Memorandum of Understanding constitutes agreement between the High Desert Area Local, APWU and the Management of the United States Postal Service at Rosamond, California 93560. This agreement is entered into pursuant to the terms of Article XXX of the National Agreement signed on July 21, 1978 between the American Postal Workers Union, AFL-CIO and the United States Postal Service.

ITEM 1 Additional or longer Wash-up periods. Installation heads shall grant reasonable wash-up time to those employees who perform dirty work or work with toxic materials. This time will be provided after handling mail and before working the window associates duties, before lunch, and prior to the end of their tour. ITEM 2 Formulation of local leave program. A. The formulation of the local leave program will be administered to be consistent with the 1998 National Agreement. B. Employee's approved vacation period will not be cancelled except in an emergency situation. C. Relinquished vacation periods shall be posted on the leave bulletin board for re-bid by employees. D. No employee within the crafts exclusively represented by the Union shall be denied vacation period because of Postmaster/Supervisor relief. Postmaster/Supervisor vacation is separate from the craft and will not block the time on the craft leave board. E. After completion of leave board, all open time will be available to any clerk regardless of seniority. The date of Postmaster/Supervisor approval on the 3971 will be the factor of which determines who submitted their 3971 first. ITEM 3 The duration of the choice vacation period. January 2nd through November 30 is open to all clerk craft employees. NO LEAVE DURING THE MONTH OF DECEMBER. The exception will be any leave in the last week of November that (because of the calendar week) ends in the first week of December. ITEM 4 The determination of the beginning day of an employee's vacation period. The first day of Vacation will be Monday and the last day will be Saturday. Any employee who has approved and scheduled Annual Leave will not be scheduled to work on the Sunday prior to or the Sunday immediately following the last day of their vacation. The exception to this rule is if the employee volunteers to work either of these days. The final decision would be at the discretion of the Postmaster/Supervisor whether to schedule this employee. ITEM 5 First round pick for vacation selection. A. First round employee may select 3 weeks. The weeks may be consecutive or separate. B. Second round is open for Daily's. Two selections may be made. C. Only one craft employee is allowed off on approved Annual Leave on any given day. Emergency Annual Leave is an exception to this rule. ITEM 6 Whether jury duty and/or attendance at National or State conventions shall be charged to the vacation Board. A. Jury Duty is to remain separate from the leave board. Jury Duty will remain at management's discretion as to allow the employee off at that time or to reschedule the Jury Duty for a date that would be operationally effective. B. The dates for the National or State Convention shall be blocked off before the first round of the vacation board. This will allow the Union Official an opportunity to attend. If the Union Official decides not to attend the convention, he can't use the time for his own personal leave. The time on the board would be opened for all clerk craft. The spot would go to the successful bidder. (As described in Item: 2, Section E.) ITEM 7 Determination of the maximum number of employees who shall have approved leave each week or day. In the clerk craft, the maximum number of employees who shall be granted leave per week or day will be one. ITEM 8 The issuance of official notices to each employee of the vacation schedule approved for him. A copy of a signed 3971 (filled out by the employee requesting the leave) signed and dated by the Postmaster/Supervisor. All copies will be returned to the employees within 48 hours. These hours are working days only. ITEM 9 Determination of the date and means of notifying employees of the beginning of the new leave year. The Union Official or designee will post a memo and/or be granted the time to verbally inform the clerk craft of the up-coming vacation board. This should be done two weeks prior to the selection period to give the employees ample time to check with their families. ITEM 10 The procedure for submission of application for annual leave after vacation board is finished. A. Form 3971 will be submitted in triplicate and after being signed and dated by the Postmaster/Supervisor, the second copy will be returned to the employee and the third copy to the Union Official or designee to mark on the leave calendar. B. If leave is disapproved, reason for disapproval must be given on the 3971. C. Leave for this time period will be approved on a first come, first serve basis. In the case of two being submitted on the same day - seniority will prevail. D. The procedures listed above (Item: 10 - A,B,C) will apply to the entire calendar year. ITEM 11 Those other items which are subject to local negotiations as provided in the craft provisions of this agreement. There shall be a labor-management meeting held once a quarter at a time convenient to both parties. Labor and Management will furnish a copy of their agenda twenty-four (24) hours prior to the meeting. Local implementation of this agreement relating to seniority, reassignments, and posting. A. The employer shall furnish the Union with up-to-date seniority lists of all Regular, Part Time Flexible, Transitional, and Casual employees in the clerk craft as they are changed. B. The employer shall consult with the Union to consider the Union's proposals, in each case where a vacant assignment is to be changed before reposting for bid. C. The employer shall consult with the Union, to consider the Union's proposal in each case where a new assignment is to be established. D. Any assignment that is to be changed more than one hour in starting time, or has any part of the assignment description changed, shall be re-posted for bid. E. Any assignment where the scheduled days off are changed shall be re-posted for bid. ITEM 12 The procedures for submission of applications for annual leave during other than choice vacation period. A. Form 3971 will not be accepted before January 1 of the leave year. B. Before submitting 3971's, punch in time clock to record the date and time of submission. C. Form 3971 shall be submitted in duplicate, with the duplicate being returned to the employee within five days of submission, with approval or disapproval. If disapproved, a reason for disapproval must be given. D. Leave submissions for this period will be approved on a first come, first serve basis on Form 3971. In case of a tie, seniority will prevail. E. The number of employees who shall receive leave at this time is also two employees or sixteen percent of the employees. F. If leave is disapproved it will not be granted to any other employee for that time period unless in case of an emergency.
SIGNATORY AGREEMENT It is understood by the parties signatory to this Agreement that any violation of this agreement shall be subject to the Grievance-Arbitration Procedures outlined in Article XV of the National Agreement.
