ITEM 21 Those other items which are subject to local negotiations as provided in the craft provisions of this agreement. ITEM 22 Local implementation of this agreement relating to seniority, reassignments.
ITEM 1 Additional or longer Wash-up Time: Wash-up time will be three (3) minutes prior to lunch and five (5) minutes prior to the end of the tour. ITEM 2 The establishment of a regular work week for five days with either fixed or rotating days off. Full time positions will be posted with a regular work week of five days with either fixed or rotating days off. ITEM 3 Guidelines for the curtailment or termination of postal operations to conform to orders of local authorities as local conditions warrant because of emergency conditions. A. To take whatever actions may be necessary to carry out its mission in emergency situations, an unforeseen circumstance or a combination of circumstances which calls for immediate action in a situation which is not expected to be of a recurring nature. B. Emergencies will be determined as given in the ELM 519. C. Guidelines for emergencies as given in the ELM 519. ITEM 4 Formulation of local leave program. A. The formulation of local leave program will be administered to be consistent with the 1990 National Agreement of the local Memorandum of Understanding. B. Employee's approved vacations will not be canceled except in emergency situations. C. Relinquished vacation periods shall be posted and granted to any other employee on a first come, first serve basis. D. No employee within the crafts, exclusively represented by the Union, shall be denied vacation because of supervisor relief. E. Times not bid for will be available throughout the year on a first come, first serve basis. ITEM 5 The duration of the choice vacation period. The choice vacation period will last from the last Sunday of April to the last Sunday in October. ITEM 6 The determination of the beginning day of an employee's vacation period. The beginning day of the employee's vacation period will be the Sunday of the employee's regular basic work week. ITEM 7 Whether employees at their option may request two selections during the choice vacation period, in units of either five or ten days. Employees may request two selections during the choice vacation period, not to exceed 15 days at first choice. ITEM 8 Whether jury duty and attendance at national or state conventions shall be charged to the choice vacation period. If a national or state convention falls within the choice period, the number of union officials who attend the convention will be one over and above the number normally allowed off. ITEM 9 Determination of the maximum number of employees who shall receive leave each week during the choice vacation period. A. The number of employees who shall receive leave each week will be two employees or sixteen percent of the employees, whichever is greater. B. Fractions of .70 and above will be counted as one whole number. C. Clerk craft annual leave shall be dealt with separately from maintenance craft annual leave, with the same percentage applying. ITEM 10 The issuance of official notices to each employee of the vacation schedule approved for such employee. A. The signing of the vacation roster shall be sufficient notice of intended annual leave, and shall be done within two weeks after the submission date. All employees will submit a leave request in duplicate, having duplicate portion approved or disapproved and returned to the employee. ITEM 11 Determination of the date and means of notifying employees of the beginning of the new leave year. The employer shall, no later than November 1, publicize on the bulletin board and by other appropriate means, the beginning date of the new leave year, which shall begin on the first day of the first full pay period of the calendar year. ITEM 12 The procedures for submission of applications for annual leave during other than choice vacation period. A. Form 3971 will not be accepted before January 1 of the leave year. B. Before submitting 3971's, punch in time clock to record the date and time of submission. C. Form 3971 shall be submitted in duplicate, with the duplicate being returned to the employee within five days of submission, with approval or disapproval. If disapproved, a reason for disapproval must be given. D. Leave submissions for this period will be approved on a first come, first serve basis on Form 3971. In case of a tie, seniority will prevail. E. The number of employees who shall receive leave at this time is also two employees or sixteen percent of the employees. F. If leave is disapproved it will not be granted to any other employee for that time period unless in case of an emergency. ITEM 13 The method of selecting employees to work on a holiday. Holiday scheduling shall be in the following order: A. Volunteers PTF's. B. Volunteer Regulars C. Flexibles D. Non-volunteers on their regular scheduled day. E. Non-volunteers on their non-scheduled day. ITEM 14 Whether "overtime desired" list in article VIII shall be by section or tour. A. The "overtime desired" list shall be posted every three months. B. When overtime is to be given, employees shall be notified at least two (2) hours in advance and shall be allowed one local telephone call. C. If employee refuses to work for any reason his or her name may be taken off "overtime desired" list at that time. ITEM 15 The number of light duty assignments within each craft or occupational group to be reserved for temporary or permanent light duty assignments. Light duty assignments will be considered on a craft unit basis when practicable. ITEM 16 The method used in reserving light duty assignments so that no regularly assigned member of the regular work force will be adversely affected. Light duty assignments shall be supplemental to regular assignments, and can include temporary assignments to vacant positions until such time as they have gone through the bidding procedure and assigned to the successful bidder. Under no condition shall light duty assignments be created to circumvent regular assignments, or in any other way jeopardize them. Nothing in this section shall be construed to mean that employees on light duty assignments have the right to "bump" a regularly assigned employee. ITEM 17 The identification of assignments that are to be considered light duty within each craft represented in the office. A. If, in the event there are not a sufficient number of light duty assignments in one craft, employees of the crafts exclusively represented by the Union that qualify for permanent or temporary light duty assignments may be placed temporarily in a light duty assignment of another craft, providing that any of the qualification criteria is met. B. Employees on light duty assignments shall not work more than eight hours in one day, or forty hours a week. C. Any job, non scheme, where qualified, within doctors restrictions. ITEM 18 The identification of assignments comprising a section, when it is proposed to reassign within an installation employees excess to the needs of a section. The entire office will comprise one section. ITEM 19 The assignment of employee parking spaces. The employer shall make every effort to provide parking spaces for employees. ITEM 20 The determination as to whether annual leave to attend union activities requested prior to determination of the choice vacation schedule is to be part of the total choice vacation plan. Leave for Union activities shall not be considered part of employee's choice vacation. ITEM 21 Those other items which are subject to local negotiations as provided in the craft provisions of this agreement. The labor-management committee meeting shall be held every two months, or more often, except for the month of December. ITEM 22 Local implementation of this agreement relating to seniority, reassignments. A. The employer shall furnish the union with an up to date seniority list of all regulars and flexible employees in the clerk craft once every six months. B. The employer shall consult with the union to consider the Union's proposals, in each case where a vacant assignment is to be changed before reposting for bid. C. The employer shall consult with the union, to consider the union's proposals in each case where a new assignment is to be established. D. Bids shall remain posted for seven days. E. Successful bidders for a vacant assignment shall be placed in the assignment within ten days, or less, if possible, from posting the successful bidder. F. A copy of any new assignment shall be supplied to the Union.
ARTICLE XXXXIV Supplemental Agreement maintenance craft. The provisions as outlined in this agreement shall cover all employees of the Maintenance Craft. ARTICLE XXX Local Implementation It is understood by the parties signatory to this agreement that any violation of this agreement shall be subject to the grievance arbitration procedures outlined in Article XV of the national agreement.
PREAMBLE This Memorandum of Understanding constitutes agreement between the High Desert Area Local, APWU and the Management of the United States Postal Service at Ridgecrest, California 93555. This agreement is entered into pursuant to the terms of Article XXX of the National Agreement between the American Postal Workers Union, AFL-CIO and the United States Postal Service. Gilbert A.
